Terms of Service

1. Services

Pilates by Karlis ("we", "us", "Karla") offers Pilates and sculpt instruction services in and around Miami, Florida, including:

• Private 1:1 Pilates sessions (in-home or virtual)
• Duo private sessions
• Group studio classes
• Private events and Pilates Parties

All services are subject to these Terms of Service. By contacting us to book any service, you agree to these terms.

2. Booking & Deposit

A 50% non-refundable deposit is required to confirm any booking. No booking is confirmed until the deposit has been received.

The remaining 50% balance is due on the day of the session or event, before the class begins.

Pilates by Karlis reserves the right to cancel an unconfirmed booking if the deposit is not received within a reasonable time after the initial agreement.

3. Cancellation & Rescheduling

Cancellations and rescheduling requests are subject to the following policy:

• 7 or more calendar days before the scheduled date: The deposit may be transferred to a future booking, to be used within 60 calendar days of the original date. No cash refund is issued.
• Less than 7 calendar days before the scheduled date: The deposit is forfeited. No transfer or refund is available.

Deposits are non-refundable under any circumstances. All rescheduling requests must be made in writing by contacting [email protected].

4. Instructor Cancellation

If Pilates by Karlis must cancel a confirmed session due to illness, emergency, or any other circumstance, the client will be offered:

• A full rescheduling at no additional charge, at a mutually agreed date; or
• A full refund of the deposit paid.

Pilates by Karlis is not liable for any additional costs or damages beyond the refund of the deposit in the event of an instructor cancellation.

5. Late Arrivals & No-Shows

Sessions begin at the scheduled time regardless of participant arrival time. Late arrivals do not extend the session duration.

If a client fails to appear at the scheduled location and time without prior notice ("no-show"), the session is considered forfeited and the deposit will not be refunded or transferred.

6. Force Majeure

Pilates by Karlis shall not be liable for any cancellation, delay, or failure to perform due to circumstances beyond its reasonable control, including but not limited to: severe weather events (including tropical storms and hurricanes), natural disasters, public health emergencies, power outages, or acts of God.

In such cases, Pilates by Karlis will make reasonable efforts to reschedule the session at no additional cost to the client.

7. Physical Participation & Liability Waiver

Participation in all sessions and events is subject to the Liability Waiver available at pilatesbykarlis.com/waiver.html. By booking any service with Pilates by Karlis, you confirm that you have read and accepted the waiver terms, including the voluntary assumption of physical risk and the release from liability.

8. Health & Medical

All participants are advised to consult a licensed physician or qualified healthcare provider before beginning any exercise program. By booking a session, you represent that you are in adequate physical health to participate.

Pilates by Karlis is not responsible for injuries or adverse health events arising from pre-existing conditions not disclosed prior to the session. Participants with injuries, medical conditions, or recent surgeries must inform the instructor before the session begins.

9. Photography & Recording at Events

Photography and video recording may take place during Pilates Party events for promotional purposes. By attending an event, participants consent to being photographed or recorded in group settings unless they notify the instructor in advance that they do not wish to appear in promotional materials.

10. Governing Law & Dispute Resolution

These Terms of Service are governed exclusively by the laws of the State of Florida, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or our services shall be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida. You consent to the personal jurisdiction of such courts.

11. Changes to These Terms

Pilates by Karlis reserves the right to modify these Terms of Service at any time. The current version is always available at pilatesbykarlis.com/terms.html. Continued use of our services after any update constitutes acceptance of the revised terms.
